Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail as he was arrested in connection with FIR No.59/2023, dated 24/01/2023, registered with Shirdi Police Station, Taluka Rahata, District Ahmednagar, for offences punishable under Sections 406, 420, 465, 417, and 418 of the Indian Penal Code, as well as under Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999.

This Court, by order dated 13/06/2025, noted the submission of the learned counsel for the applicant as under : - "The learned counsel for the applicant submits that the applicant is arrested on 26th December, 2024. Charge sheet is filed on 21.02.2025 and the investigation is complete. He further submits that the total amount of Rs.7,23,525/- is allegedly siphoned by the accused persons. He submits that no further custody of the applicant is warranted as the trial Court would take substantial time to conclude the trial. He further submits that the applicant is ready to submit his property details to the Investigating Officer as a security towards the alleged siphoned amount."

The learned APP today has placed on record instructions regarding the applicant's property details, confirming that the applicant owns land admeasuring 1 hectare in Gat No.260. The learned counsel for the applicant submits that, till the conclusion of the trial, the applicant undertakes not to sell or create third party interest in the said property situated at Mouje Mahakal Wadgaon, Taluka Shrirampur, District Ahmednagar.

Considering that the investigation is complete, the applicant has been in custody since 26/12/2024, and the total alleged amount involved, Rs.7,23,525/-, is secured by security, the applicant is granted bail. 6.

In view of the above, the application is allowed in the following terms: - a] The applicant shall be released on bail in connection with FIR No.59/2023, dated 24/01/2023, registered with Shirdi Police Station, Tq. Rahata, District Ahmednagar, for the offences punishable under sections 406, 420, 465, 417, 418 of Indian Penal Code and under Section 3 of Maharashtra Depositors (Protection of Interest in Financial Institutions) Act, 1999, on furnishing PR bond of Rs.25000/- with one or two sureties in the like amount to the satisfaction of the trial Court.

b] The applicant, upon being released on bail, shall not contact the informant, in any manner whatsoever, during the pendency of the trial.

43 BA 710-2025 c] The applicant shall co-operate with the trial Court and he shall attend each and every date, unless exempted by the trial Court. d] The applicant shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses and other persons concerned with the case.

e] The applicant, upon being released on bail, shall place on record of the trial Court the details of his Contact Number and residential address with updates in case of any change. f] The applicant shall not sell or create any third-party interest in the land admeasuring 1 hectare, bearing Gat No. 260, situated at Mouje Mahakal Wadgaon, Taluka Shrirampur, District Ahmednagar, till the conclusion of the trial.

Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the applicant shall be liable to be cancelled. It is also clarified that the observations made in this order are limited to the disposal of the present bail application. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
