Applicant has filed this application is filed seeking temporary bail.

Learned Counsel for the Applicant submits that the father of Applicant is undergoing treatment for cancer. Applicant, therefore, seeks interim bail to visit his ailing father. 3.

Learned APP vehemently opposed the application submitting that the Applicant is involved in a serious crime. The provisions of Maharashtra Control of Organized Crime Act are invoked against him. The solitary reason regarding ailment of father was already submitted before the Trial Court as well as this Court.

Upon considering submissions of both sides, it is prima facie evident that the Applicant is behind the bars since 12 years. He is involved in several serious offences. Even, provisions of Maharashtra Control of Organized crime Act are invoked against him. Furthermore, it is prima-facie evident that this is the successive application. Observantly, the Court came to know that the Applicant has raised similar grounds in the previous application and no new ground is raised. Hence, in the absence of any new ground, the application does not warrant consideration. In such circumstances, in my view, this is not a fit case to grant temporary bail to the Applicant.

In the result, application stands rejected.
