This Court had called report from Additional Sessions Judge, Jalgaon regarding progress of trial. The report dated 23.02.2026 is received from District Judge, Jalgaon, which suggests that on 08.01.2026 witness was present. However, Advocate of accused no.2 remained absent. Thereafter, Mr. S. R. Patil appeared on behalf of accused no.2 and prosecution is directed to take effective steps to secure presence of witnesses on 06.03.2026. 2.

Prima facie, it appears that, matter is adjourned at the instance of accused no.2 and, therefore, trial could not be started. 3.

In that view of matter, learned Advocate appearing for applicant, on instructions, seeks permission to withdraw application with liberty to move after six months in case trial could not be proceeded.
