Applicant is seeking temporary bail for 60 days due to ill health of his mother.

It is submitted by the learned counsel for the applicant that his mother is seriously ill, who is staying at Dagarwad, Tq. Beriya, Dist. Baliya, State of U. P. There is nobody to look after her. The medical papers are placed on record to show the ailment. It is submitted that she cannot be given treatment as the applicant is behind bar. He is arrested on 15.12.2022. Therefore on sympathetic ground it is prayed that he be released on bail.

Learned Assistant Public Prosecutor tenders on record written instructions received by him disclosing that applicant's mother was admitted in hospital on 12.02.2026 and discharged on 13.02.2026. It is further disclosed that applicant has a brother. It is submitted that applicant is involved in serious economic offence and he could not comply the condition of depositing the amount, hence application is liable to be rejected. 5.

It reveals from record that the allegations against the applicant are having defrauded the informant and number of persons and extracted amount of about Rs. 39.60 Lakhs by luring them to provide a job. He was granted bail vide order dated 23.02.2023 on condition of depositing Rs. 20,00,000/-. He could not fulfill the condition. Therefore, further application was made to relax the condition and relaxation was granted vide order dated 09.04.2025, but the same has also not been complied. 6.

It is reported that applicant is having a brother. He is a married persons. It cannot be countenanced that there is nobody in the family to look after the ailing mother. I find no substance in the application. It is rejected.
