The applicant is seeking enlargement on bail in connection with Crime No. 473 of 2025, registered with MIDC Waluj Police Station, Dist. Chhatrapati Sambhajinagar for the offences punishable under Section 310(2), 61(2), 317(3) of of Bharatiya Nyaya Sanhita, 2023, under section 3, 4, 25 of Arms Act, under section 135 of the Maharashtra Police Act.

It is reported with the Police that dacoity took place in the intervening night of 14 February 2025 and 15 February 2025 at the house of Mr. Santosh Laddha. The watchman - Sanjay Zalke, who was guarding the house, was assaulted, 1/4

2 2014 - 2025 threatened and tied. The armed accused persons committed the dacoity worth Rs.3,46,75,000/- comprising of gold, silver ornaments, cash and mobile handsets. The applicant is alleged to be the conspirator with the remaining accused persons. He was arrested on 31.05.2025. The chargesheet is filed on 18.08.2025.

Learned counsel for the applicant Mr. Sudarshan Salunke submits that no material is available against the applicant and merely on the suspicion, he is implicated in the offence, He has neither received any stolen property nor received any unlawful gains. The co-accused, namely, accused no. 9, 10 and 11, against whom identical roles are attributed, have been released on bail. Applicant, in fact, was helping the watchman and other persons by providing them food when the owner was away at abroad.

Learned APP would submit that it is deep-rooted and well hatched conspiracy. The applicant is the mastermind. He was associated with Mr. Laddha and was having detail information and coordinated other accused persons so as to facilitate the dacoity. The involvement is manifest from CDR and SDR reports. The statements of the witnesses Babasaheb Sable and Sanjay Zalke would show involvement.

Applicant is employee of the owner Santosh Laddha. He was associated with the owner as they were from the same place. Applicant was aware that Mr. Laddha and Mrs. Laddha had been to USA from 7.5.2025 to attend the convocation of their son. .

I have gone through the statement of Babasaheb Sable and Sanjay Zalke. Nothing incriminating is found against the applicant. He was aware that the owner was abroad and he was, in fact, providing meals at the spot to the watchman. Supplementary statement of Sanjay Zalke shows that conspiracy was hatched and the applicant supplied information to other accused persons, so as to facilitate them to commit the offence. The employees like applicant and witnesses were aware that Mr. and Mrs. Laddha had been abroad. 2/4

My attention is adverted to call mapping and reports of the CDR and SDR. It can be inferred that there was some active co-ordination amongst the applicant and other persons. No material is shown by learned APP to point out specific role played by the applicant. He is stated to have supplied the information. On the face of the record, the information cannot be said to be secret or of such a nature, which helped the other accused persons to commit dacoity of articles worth more than Rs.3 Crores. 9.

In the absence of any independent material, it would not be possible to detain the applicant behind bars any more. 10.

The co-accused - Adinath, Ganesh, Mahesh and Rupesh have already been enlarged on bail. The applicant is behind the bars since 31.05.2025. The investigation is over. No antecedents are reported against him. It is desirable to release the applicant on bail.

Hence, the following order :-

ORDER

I) The Bail Application is allowed.

II) The applicant shall be released on bail in connection with Crime No. 473 of 2025, registered with MIDC Waluj Police Station, Dist. Chhatrapati Sambhajinagar for the offences punishable under Section 310(2), 61(2), 317(3) of of Bharatiya Nyaya Sanhita, 2023, under section 3, 4, 25 of Arms Act, under section 135 of the Maharashtra Police Act, on following conditions: (a)The applicant shall furnish P.R. bond of Rs.50,000/- (Rs. Fifty Thousand only) with one solvent surety of like amount. (b)The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.

(c)The applicant shall surrender Adhaar / PAN cards, if any, to the Investigating Officer.

4 2014 - 2025 (d) The applicant shall not leave Chhatrapati Sambhajinagar district without permission of the Investigating Officer. (e) The applicant shall co-operate for expeditious disposal of the trial.
