By this application, the applicant seeks regular bail in connection with Crime No.867/2025, registered with Sangamner City Police Station, District Ahilyanagar for the offences punishable under Sections 64(2)(m), 74, 78, 308(2), 351(2) of the Bhartiya Nyaya Sanhita, 2023.

The prosecution case is that, the applicant started residing in the neighbourhood of the complainant since last one and half year as such. The complainant was acquainted with him. Thereafter they became friends which culminated in love relations. As her husband and parents-in-law came to know about their love affairs, both the informant and applicant discontinued relationship for about 4 to 5 months. Thereafter, the applicant started insisting the complainant to continue relationship, and threatened to defame her.

It is alleged that, on 29/9/2025 at about 9.00 p.m., when the complainant was coming by bus to Sangamner, the applicant also entered into the bus and when the bus reached at Sangamner Bus Stand, the applicant asked her to join in his Scorpio Car and threatened to defame her by showing her photos to all in case she

does not join. Therefore, due to fear, she accompanied the applicant in the Scorpio. The applicant allegedly drove the complainant to an open space, where accused insisted and pressurised her to enter into relationship with him. When the complainant refused, the applicant forcefully tried to establish physical contact with her. The complainant resisted by kicking the applicant. The applicant fled from the scene by his Car and in the process, dashed to a two wheeler in the process. The complainant reached the bus stand and informed her husband about the incident and subsequently the report came to be lodged. 5.

Learned counsel for the applicant submits that, the parties have reached an amicable settlement and have resolved the dispute. Learned counsel for the respondent/ informant has confirmed the same and has no objection for release of the applicant on bail.

The learned A.P.P. has opposed the bail application and has prayed to pass appropriate orders in the interest of justice. 7.

In view of the aforestated facts and circumstances, coupled with the fact that the investigation is complete and Charge

Sheet is filed, I am of the considered opinion that no fruitful purpose would be served by further incarceration of the applicant behind the bars. As such, the application deserves to be allowed. However, by imposing conditions.

Considering the fact that the parties are resolute to resolve the dispute, the applicant is arrested on 15/10/2025. In that view of the matter, further custody of the applicant is not warranted. 9.

Hence the order :

O R D E R

(i) Bail Application is allowed.

(ii) The applicant Prem Sanjay Zinjurde be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand) with one solvent surety of the like amount in the above crime, on the conditions that :

(a) The applicant shall not tamper with the prosecution witnesses in any way.

(b) The applicant shall remain present on each date, unless exempted by the trial Court.

(iii) Needless to state that, the observations rendered herein are confined to the present application, and the trial Court shall decide the trial on its own merits and in accordance with law.
