1] Heard. For the reasons stated in Criminal Application No.233 of 2025, the same is allowed. Criminal Application is disposed of accordingly.
2] Heard learned counsel for the applicants and the learned APP for the respondent-State.
3] The learned counsel for the applicants, on instructions, seeks leave to withdraw the present application
in respect of applicant no.2, namely, Aniket Sukhadeo Gudekar. Leave granted. The Anticipatory Bail Application in respect of applicant no.2 is dismissed as withdrawn. 4] The applicant no.1, namely, Shubham Ashok Shinde, is apprehending arrest in connection with Crime No. 375/2024, registered at Belwandi Police Station, District Ahmednagar, for the offences punishable under Sections 109, 189 (2), 191 (2) (3), 190, 115 (2), 351 (2) (3), 352, 119 (1), 324 (4) of BNS and under Section 4/25 of Arms Act.
5] The case against the applicant no.1 is that the applicant no.1 along with other accused assaulted the informant. However, prima facie the name of the applicant no.1 is not reflected in the FIR, so also, in the supplementary statement of the informant. This fact is not disputed. Considering the same, the application of applicant no.1 is allowed in the following terms :
i] In the event the applicant no.1 is arrested in connection with Crime No.375/2024, registered at Belwandi Police Station, District Ahmednagar, for the offences punishable under Sections 109, 189 (2), 191
(2) (3), 190, 115 (2), 351 (2) (3), 352, 119 (1), 324
(4) of BNS and under Section 4/25 of Arms Act, he shall be released on bail on furnishing PR bond of
Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. ii] The applicant no.1 shall attend the concerned police station from 31.01.2025 and 01.02.2025 between 10.30 a.m. to 1.30 p.m. and thereafter as and when called by the investigating officer. iii] The applicant no.1 shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.
iv] The applicant no.1 shall co-operate with the investigation and also in the proceedings before the trial Court.
6] In the event, the applicant no.1 violates any of the conditions specified in this order, it shall be liable to be cancelled.
7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
8] The application stands disposed of.
