Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with Crime No.0395/2024, dated 07.08.2024, registered at Jamkhed Police Station, District Ahmednagar, for the offences punishable under Sections 316(2), 316(5), 318(4), 61(2) of the Bharatiya Nyaya Sanhita, 2023 and under Section 3 of the MPID Act, 1999. 3.

The learned Public Prosecutor submits that Dnyanradha Multi-state Co-operative Credit Society Ltd. has a branch at Jamkhed. As far as the Jamkhed branch is concerned, there are two current accounts, one in Chhatrapati Rajshri Shahu Urban Co-operative Bank and and

2 951 another in ICICI Bank. The learned counsel submits that for the period 01.04.2019 to 25.10.2023 the applicant has withdrawn Rs.2.18 Crores from Chhatrapati Rajshri Shahu Urban Co-operative Bank in cash. The cash withdrawn is not accounted for and the investigation is a crucial stage where interim protection if granted will effect the investigation. 4.

Considering the above submissions of the learned Public Prosecutor that the cash withdrawn by the applicant is not accounted for, this would not be a fit case for grant of anticipatory bail. The anticipatory bail application stands dismissed.

It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall not be influenced with the observations while deciding regular bail or at the stage of trial. [ARUN R. PEDNEKER, J.] marathe
