Heard the learned counsel for the applicant, the learned APP for the respondent-State and Mr. Rahil Kazi, advocate for assisting APP. 2.

The applicant has approached this Court apprehending arrest in connection with Crime No. 513/2025 dated 21.11.2024 registered with Jalgaon City Police Station, Jalgaon, Dist. Jalgaon for the offences punishable under sections 191(2), 191(3), 190, 109, 118(2), 352, 351(3) of B.N.S.

The learned counsel for the applicant submits that in the video submitted by the informant of the incident the applicant is not seen at the scene of offence. The learned counsel for the applicant further submits that the eye witnesses, whose statements are recorded, do not show that the applicant is named as one of the assailant. However, the learned counsel for assisting APP submits that the incident is of longer duration and from the statements of witnesses, it appears that the applicant is present on the scene of offence.

The learned counsel for the applicant submits that there is prior enmity between the parties and earlier also FIR has been registered against the applicant by the informant. He therefore prays to grant interim relief to the applicant.

The learned APP submits that if the court is inclined to grant the interim protection, direction may be given to the applicant to attend the police station.

Considering the above submissions, interim protection can be granted to the applicant.

In the meanwhile, there shall be interim order in the following terms :- A] Till the next date, in the event the applicant is arrested in connection with Crime No. 513/2025 dated 21.11.2024 registered with Jalgaon City Police Station, Jalgaon, Dist. Jalgaon for the offences punishable under sections 191(2), 191(3), 190, 109, 118(2), 352, 351(3) of B.N.S., he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount. B] The applicant shall remain present before the investigating officer on 13th and 14th May, 2025 between 10.30 a.m. and 01.30 p.m. and thereafter as and when required by the investigating officer.

C] The applicant shall co-operate with the investigation, including producing all documents in his possession, as may be demanded by the investigating officer.

D] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the

evidence.

Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled.

List on 12.6.2025. Interim protection granted today to continue till then only.
