1] Heard learned counsel for the applicant and the learned APP for the respondent-State.

2] The applicant has approached this Court apprehending arrest in connection with Crime No.43/2025, registered with Partur Police Station, District Jalna, for the offence punishable under Sections 3, 7 of the E.C.Act and under Section 318 (4), 336 (2), 336 (3), 339, 340 (2), 341

(1) of the B.N.S.

3] The learned counsel for the applicant submits that there is no evidence that the applicant has lifted the rice from the fair price shop, therefore, in absence of evidence the offence under Essential Commodities Act

would not constitute offence against the present applicant. He further submits that the maximum punishment is of 3 years for the aforesaid offences.

4] Considering the submissions of the applicant, the applicant is granted interim protection in the following terms :- A] Till the next date, in the event the applicant is arrested in connection with Crime No.43/2025, registered with Partur Police Station, District Jalna, for the offence punishable under Sections 3, 7 of the E.C.Act and under Section 318 (4), 336 (2), 336 (3), 339, 340 (2), 341 (1) of the B.N.S., he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount.

B] The applicant shall attend the concerned police station as and when required by the investigating officer.

C] The applicant shall co-operate with the investigation, including producing all documents in his possession, as may be demanded by the investigating officer.

D] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.

5] Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled. 6] List on 28.04.2025. Interim protection till the next date.
