1] Heard learned counsel for the applicant and the learned APP for the respondent-State.

2] The applicant has approached this Court apprehending arrest in connection with Crime No.0623/2024, registered with Karjat Police Station, Karjat, District Ahmednagar, for the offences punishable under Sections 189(2), 191(2), 191(3), 190, 118(2), 118(1), 308(2), 115(2), 119(1), 352, 351(3) of the Bharatiay Nyaya Sanhita, 2023.

3] The learned counsel for the applicant relies upon the order dated 31.01.2025, passed in ABA/1983/2024 along with connected matters. He submits that as regards the assault on the informant is concerned,

the role of the present applicant is identical to the other coaccused. However, the learned counsel for the applicant submits that the additional allegation against the present applicant is that he has taken Rs.35,000/- from the counter of the shop. He submits that such an allegation is only made so as to make the offence more grievous in nature and that the applicant has not taken the money.

4] The learned APP submits that Rs.35,000/- is to be recovered from the present applicant.

5] Considering the submissions, in the meanwhile, there shall be interim order in the following terms :- A] Till the next date, in the event the applicant is arrested in connection with Crime No.0623/2024, registered with Karjat Police Station, Karjat, District Ahmednagar, for the offences punishable under Sections 189(2), 191(2), 191(3), 190, 118(2), 118(1), 308(2), 115(2), 119(1), 352, 351(3) of the Bharatiay Nyaya Sanhita, 2023, he shall be released on bail on furnishing PR bond of Rs.15,000/- with one or two sureties in the like amount.

B] The applicant shall attend the concerned police station on 25.04.2025 and 26.04.2025, between 10:30 a.m. to 01:30 p.m.

C] The applicant shall co-operate with the investigation, including producing all documents in his possession, as may be demanded by the investigating officer.

D] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.

6] Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled. 7] List on 05.05.2025.
