1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant has approached this Court apprehending arrest in connection with Crime No.277/2024, registered with Bhusawal Taluka Police Station, Bhusawal, District Jalgaon, for the offence punishable under Sections 179, 180 and 3 (5) of the Bharatiya Nyaya Sanhita, 2023.
3] The learned counsel for the applicant submits that applicant, who is a priest by profession along with companion were travelling in a vehicle and the said vehicle met with a severe road accident near Nirmala Dhaba, Varangaon Bhusawal highway. He further submits that the
police recovered bag from the vehicle containing Rs.2,22,700/-. Out of the said amount, Rs.56,200/- was found fake currency. He further submits that the vehicle involved in the accident was not owned by the applicant. He further submits that in the accident, the applicant has suffered serious injuries and he is admitted in the Hospital. 4] Prima facie, there is no material to implicate the present applicant in the alleged crime as it cannot be said that the bags belong to the applicant and the applicant is medically serious on account of injury sustained in the accident, the applicant is granted interim protection in the following terms :- A] Till the next date, in the event the applicant is arrested in connection with Crime No.277/2024, registered with Bhusawal Taluka Police Station, Bhusawal, District Jalgaon, for the offence punishable under Sections 179, 180 and 3 (5) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount.
B] The applicant shall attend the concerned police station as and when required by the investigating officer.
C] The applicant shall co-operate with the investigation, including producing all documents in his possession, as may be demanded by the investigating officer.
D] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.
5] Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled. 6] List on 18.06.2025. Interim protection till the next date.
