Heard the learned counsel for the applicant and the learned APP for the respondents-State.

The applicant has approached this Court, apprehending arrest in connection with Crime No. 310/2024 dated 21.6.2024 registered with Jamner Police Station, District Jalgaon for the offence punishable under sections 307, 308, 353, 332, 333, 143, 147, 148, 341, 342, 435, 323, 504, 506, 427 r/w. 149 of IPC, sections 3 and 7 of Prevention of Damage to Public Property Act, section 7 of Criminal Law Amendment Act and section 37(1)(3) r/w. 135 of Maharashtra Police Act.

The learned APP seeks time and submits that if the court is inclined to grant interim protection, the applicant may be directed to attend the police station.

Considering the earlier order passed by this Court in ABA No. 2009/2024 dated 9.1.2025, granting anticipatory bail to the applicant therein and considering that the applicant was later on added as accused in this crime and considering that it is not known at this stage whether the

ABA 715/25 applicant was seen in the CCTV footage, interim protection can be granted to the applicant.

In the meanwhile, there shall be interim order in the following terms :- A] Till the next date, in the event the applicant is arrested in connection with Crime No. 310/2024 dated 21.6.2024 registered with Jamner Police Station, District Jalgaon for the offence punishable under sections 307, 308, 353, 332, 333, 143, 147, 148, 341, 342, 435, 323, 504, 506, 427 r/w. 149 of IPC, sections 3 and 7 of Prevention of Damage to Public Property Act, section 7 of Criminal Law Amendment Act and section 37(1)(3) r/w. 135 of Maharashtra Police Act, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount. B] The applicant shall remain present before the investigating officer on 16th and 17th May, 2025 between 10.30 a.m. and 1.30 p.m. and thereafter as and when required by the investigating officer. C] The applicant shall co-operate with the investigation, including producing all documents in his possession, as may be demanded by the investigating officer.

D] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.

Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled.

List on 17.6.2025. Interim protection granted today to continue till then only.
