Heard the learned Advocates for the parties.

The Applicant has filed this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, as he apprehends arrest.

The proceedings relate to Crime No.0198/2025 registered by Shirdi Police Station, District Ahilyanagar. FIR has been registered on 23 February 2025 at 19:53 hours. Occurrence of the offence is shown on 22 February 2025. The informant is one Chhaburao Bhadange, aged 50 years. The offences alleged under the FIR are under Sections 118(2), 3(5), 324(4) of the Bharatiya Nyaya Sanhita.

It appears from the FIR that the incident relates to quarrel between the persons mentioned in the FIR which aggravated into assault. It appears that neither is the Applicant named in the FIR, nor is any role attributed to him. His name surfaces through supplementary statement of the informant, which was recorded on 03 March 2025. Apart from this, there are no specific allegations against this Applicant. Thus, the ingredients of the alleged offences qua this Applicant are not attracted at this stage.

The learned Advocate for the Applicant states that the Applicant and the Informant are from the same village. The Applicant has no criminal antecedents.

Considering the above factual conspectus, prima facie, the Applicant deserves some protection. Hence, I pass the following order:

O R D E R

(i) Until adjourned date of hearing, in the event of arrest of the Applicant in connection with C.R. No. 0198/2025 registered with Shirdi Police Station, District Ahilyanagar for the offences punishable under Sections 118(2), 3(5), 324(4) of the Bharatiya Nyaya Sanhita, the Applicant is

*3* directed to be released on bail on his furnishing PR bond in the sum of Rs. 20,000/- (Rupees Twenty Thousand Only) with one or more sureties in the like amount.

(ii) The Applicant shall attend the concerned Police Station on every Monday at 11.30 am, until the further orders and shall cooperate with the investigation.

(iii) The Applicant shall furnish details of residential address and other contact details such as the mobile number etc. to the concerned Police Station. If there is any change in the contact details, the same shall be immediately informed to the concerned Police Station.

(iv) The Applicant shall not leave the jurisdiction of the competent Court without prior permission, until further orders.

(v) The Applicant shall not contact and/or influence the witness/es and/or tamper with the evidence in any manner whatsoever.

List the Application for further consideration/hearing on 12 August 2025.

The protection granted today in favour of the Applicant shall continue till the adjourned date of hearing. kps ( ADVAIT M. SETHNA, J. )
