The Applicant has filed the present Application as he apprehends arrest. These proceedings arise out of CR No.0165 of 2025. The FIR is lodged on 7 May 2025 at 19:03 hours by the Majalgaon Rural Police Station, Dist. Beed. The date of occurrence of the alleged incident as stated in the FIR is 4 May 2025. The FIR has been registered under Sections 351(3), 351(2), 3(5), 118(1) and 109 of the Bharatiya Nyaya Sanhita, 2023 ("BNS"). There are two accused persons, out of whom accused No.2Maharudra Baburao Badade is the present Applicant. The Informant is one Santosh Vikram Badade, who is related to the Applicant. 2.

With the assistance of the learned counsel for the parties, I have perused the FIR and the record available with the Court. The incident as reported in the FIR is of 4 May 2025. There is a reference to an alleged

assault on the Informant, where the present Applicant is also stated to be involved. The dispute relates to the water flowing from the canal into the field at the lower side. There was an altercation which led to an assault. In this regard, the role attributed to the present Applicant is that he inflicted injuries on the head and back of the Informant by using a wooden log. 3.

At this stage, Mr. Lavte, learned APP would refer to the case diary and has furnished a copy of the injury certificate. He would submit that the Applicant has been examined on 4 May 2025 at 8.30 p.m. As far as the nature of the accusations qua the Applicant is concerned, it appears that the type of injury described as contusion under left occipito parietal region and abrasion under right arm. The injuries are stated to be simple in nature. The Informant has also undergone CT brain, which was carried out on 5 May 2025. The prosecution could not dispute that he has recovered from such injuries and has no life threats due to such injuries. The Applicant does not have any criminal antecedents.

Considering the above prima facie, the Applicant deserves to be protected by passing the following order:-

ORDER

(i) Until the adjourned date of hearing, in the event of arrest of the Applicant in connection with CR No.0165 of 2025 registered with Majalgaon Rural Police Station, Dist. Beed for the offences punishable under Sections 351(3), 351(2), 3(5),

118(1) and 109 of the BNS, the Applicant is directed to be released on bail on his furnishing PR bond in the sum of Rs.20,000 (Rupees Twenty Thousand Only) with one or more sureties in the like amount.

(ii) The Applicant shall cooperate with the investigation and shall attend the concerned police station on every Monday at 11.30 a.m., until further orders.

(iii) The Applicant shall furnish details of residential address and other contact details such as mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately intimated to the concerned police station.

(iv) The Applicant shall not leave the jurisdiction of the Court without prior permission/order of the Court, until the further orders.

(v) The Applicant shall not influence the witness/es and/or tamper evidence in any manner whatsoever.

List the proceedings for further consideration on 4 August 2025. 6.

The protection granted to the Applicant shall continue until the adjourned date of hearing.
