Heard learned counsel for the parties for some time. The Application is listed for the first time today. 2.

Issue notice to the Respondent, returnable on 22 July 2025. 3.

Mr. Phule, learned APP waives service for the State. 4.

The proceedings relate to CR No.0332 of 2025. FIR is dated 27 May 2025 lodged at 16:55 hours by the Nandurbar City Police Station, Nandurbar for the offences punishable under Sections 3(5), 351(3), 351(2), 352, 126(2) and 118(1) of the Bharatiya Nyaya Sanhita, 2023 ("BNS"). The allegations against the present Applicant Raju Shaikh is that he used a knife, which caused injury to the Informant on the alleged date of the incident i.e. 26 May 2025 at 9.00 p.m. as noted in the FIR. The nature of injury and for the motive behind such assault needs to be ascertained.

Mr. Phule submits that he would take instructions in the meantime. The Informant also happens to be a reporter. 6.

Ms. Sarin would submit that apart from Section 118(1) of the BNS, most of the offences under the other provisions are bailable. The Applicant has no criminal antecedents.

In the given factual complexion, some protection is required to be granted to the Applicant by passing the following order:-

ORDER

(i) Until the adjourned date of hearing, in the event of arrest of the Applicant in connection with CR No.0332 of 2025 registered with Nandurbar City Police Station, Nandurbar for the offences punishable under Sections 3(5), 351(3), 351(2), 352, 126(2) and 118(1) of the BNS, the Applicant is directed to be released on bail on his furnishing PR bond in the sum of Rs.20,000 (Rupees Twenty Thousand Only) with one or more sureties in the like amount.

(ii) The Applicant shall cooperate with the investigation and shall attend the concerned police station as and when called by the Investigating Officer of the concerned police station. (iii) The Applicant shall furnish details of residential address and other contact details such as mobile number etc. to the concerned police station. If there is any change in the contact

details, the same shall be immediately intimated to the concerned police station.

(iv) The Applicant shall not leave the jurisdiction of the Court without prior permission/order of the Court.

(v) The Applicant shall not influence the witness/es and/or tamper evidence in any manner whatsoever.

The protection granted to the Applicant by this order shall continue until the adjourned date of hearing. 9.

In the meantime, Mr. Phule would take appropriate instructions on or before the adjourned date of hearing.
