These proceedings are listed for first time today. 3.

The proceedings relate to Crime No. 246/2025 registered with Pundliknagar Police Station, District Chhatrapati Sambhajinagar for the offences punishable under Sections 304(2), 115(2), 352, 351(3) of the Bharatiya Nyaya Sanhita (for short 'BNS'). The FIR has been lodged on 9 June 2025 at about 00.20 hours. .

The date of the occurrence of alleged offence is stated to be 8 June 2025 at 22.30 hours after which the present FIR is lodged. The Informant is one Punamsing Harising Sundarde (age 38 years). The present FIR would initially note that at the time of alleged incident there are unnamed accused persons on the place of the incident.

A perusal of the FIR with the assistance of the learned Advocates for the parties would indicate that present Applicant is one Kiran whose name comes up in the FIR. It appears that though there is an allegations against him to use a knife to inflict the injury on the Informant, it appears that there is no injury caused. The altercation appears to have taken placed at the heat of the moment which started with hurdling abuses. As discussed in the FIR fist and blows were used against the Informant by the Applicant and not any weapon, much less dangerous weapon. The Applicant has one criminal antecedents against him.

As the Application is listed for first time today, Mr. Bhadane, learned APP would take instructions with regard to the recovery of the alleged weapon as well as the mobile phone which according to the learned Advocate for the Applicant, who on instructions, states that it has been deposited with the concerned Police Station. The Applicant is ready and willing to co-operate to the investigation. In such facts and circumstances the Applicant deserves some protection by following terms and conditions.

ORDER

(i) Until adjourned date of hearing, in the event of arrest of the Applicant in connection with C.R. No. 246/2025, registered with Pundliknagar Police Station, District Chhatrapati Sambhajinagar for the offences punishable under Sections 304(2), 115(2), 352, 351(3) of the BNS,

the applicant is directed to be released on bail on his furnishing PR bond in the sum of Rs. 20,000 (Rupees Twenty Thousand Only) with one or more sureties in the like amount.

(iii) The Applicant shall cooperate with the investigation and shall attend the concerned police station on every Monday at 11.30 a.m.

(iv) The Applicant shall furnish details of residential address and other contact details such as mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately intimated to the concerned police station.

(v) The Applicant shall not leave the jurisdiction of the Court without prior permission/order of the Court, until further orders.

(vi) The Applicant shall not influence the witness/s and/or tamper evidence in any manner whatsoever.

Learned APP to communicate this order forthwith to concerned police station.

The protection granted to the Applicant by this order shall continue till the adjourned date of hearing.

Place the present application for further consideration on 28 July 2025.
