After hearing the learned Counsel for the Applicant, Mr. Jadhav, for some time, this Court was not inclined to entertain the present application in view of the proclamation issued declaring the Applicant as a proclaimed offender under Section 82 of the Code of Criminal Procedure, particularly in light of the judgment of the Hon'ble Supreme Court in Prem Shankar Prasad v. State of Bihar and Another, (2022) 14 SCC 516, and Serious Fraud Investigation Office v. Aditya Sarda, AIR Online 2025 SCC 2431. Even though the learned Counsel for the Applicant relied upon the judgments of the Hon'ble Supreme Court in Asha Dubey Vs. State of Madhya Pradesh, Criminal Appeal No. 4564 of 2024, and State of Haryana Vs. Dharamraj,
2 902(x).ABA-1246-2025.doc (2023) 17 SCC 510, this Court did not find any exceptional circumstances warranting interference in exercise of discretionary powers under Section 482 of the BNS. This Court is not inclined to entertain the application for anticipatory bail in view of the proclamation. Accordingly, the learned Counsel for the Applicant seeks permission to withdraw the application. 3.
Permission is granted.
