Heard the learned Advocate for the Applicant, the learned APP for the State and the learned Advocate for the Informant. Perused the papers on record.

Crime No.0641/2025 is registered with Shirdi Police Station, Dist. Ahilyanagar for the offence punishable under Sections 316(2), 318(4), 340(2), 336(2) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS') at the instance of the Informant. Since the Applicant is apprehending arrest in the aforesaid Crime, he has filed this Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') for Anticipatory Bail.

The case of the Informant, in brief, is that, he was willing to
purchase and the Applicant was willing to sell his property situated at Shirdi for total consideration of Rs.1,11,00,000/- (Rs. One Crore Eleven Lakh). An Agreement was entered into between both the parties. The Applicant did not inform about the encumbrance on the said property of the concerned Bank to the Informant. The Informant later on came to know about the same and requested the Applicant to execute the sale-deed, however the Applicant avoided to execute the sale-deed. Thus, the Informant rushed to the Police and the above referred Crime came to be registered.

Prima facie the dispute appears to be of a civil nature. In this view of the matter, the Applicant is protected by the following interim order till the next date. Hence, the order:
O R D E R
i) In the event of arrest of the Applicant, namely, Vijay Chhaganrao Kumawat in connection with Crime No.0641/2025 registered with Shirdi Police Station, Dist. Ahilyanagar, he be released on bail on executing P.B. of Rs.30,000/- (Rupees Thirty Thousand) with one or two surety/sureties in the like amount.
ii) The Applicant shall attend the concerned Police Station as and when called.
iii) The Applicant shall not tamper the evidence of the Prosecution in any manner.
iv) The Applicant shall co-operate with the investigating machinery. v) Issue notice to the Respondent, returnable after four (4) weeks. The learned APP waives notice for the Respondent - State.
