Heard learned counsel for the applicant and the learned APP for the respondents-State.

The applicants have approached this Court apprehending arrest in connection with FIR No. 244 of 2025 dated 13.07.2025, registered with Sonpeth Police Station, District Parbhani, for the offences punishable under Sections 123, 189(2), 190, 118(1), 115(2), 352 and 191(2) of the BNS, 2023.

Learned counsel for the applicants, Mr. Kale, submits that in view of the interim order dated 03.09.2025, applicant Nos. 2 and 3 have attended the police station and have cooperated with the 1/5

investigation. It is submitted that there are no serious allegations against the applicants and the allegations are general in nature. The specific allegation of assault is against applicant No. 1. It is further submitted that applicant No. 1 is also ready to abide by any conditions that may be imposed by this Court. The co-accused have already been arrested and released on bail and the recovery of weapons has been effected at their instance. Nothing remains to be recovered from applicant Nos. 1 to 3. Hence, the application may be allowed.

As against this, the learned APP strongly opposes the present anticipatory bail application on the ground that the applicants are involved in serious offences of causing grievous hurt by means of dangerous weapons. It is submitted that applicant No. 1 is specifically alleged to have assaulted the complainant with a stick on his leg, and the other two applicants are also specifically named in the FIR. It is further submitted that custodial interrogation of the applicants is necessary to complete the investigation. Though the applicants have attended the police station, they have not cooperated with the investigation. Hence, it is contended that the application deserves to be rejected.

I have gone through the investigation papers made available by the learned APP. Perusal of the investigation papers indicates that the 2/5

investigation is almost complete, particularly in view of the protection granted to applicant Nos. 2 and 3, who have attended the police station. There are no allegations of violation of the conditions imposed upon applicant Nos. 2 and 3. Insofar as the allegations against applicant No. 1 are concerned, learned counsel for the applicants, Mr. Kale, submits that the FIR itself reflects a dispute regarding partition of land.

Thus, taking into consideration the nature of allegations in the FIR and the background of dispute, the possibility of false implication of the present applicants cannot be ruled out at this stage. The investigation papers do not indicate any grievous injury sustained by the complainant. The apprehensions expressed by the learned APP that the applicants may commit cognizable offences or threaten the complainant can be adequately addressed by imposing stringent conditions. Hence, I am inclined to exercise powers under Section 482 of the BNSS. Accordingly, the following order is passed:-

O R D E R

i.

The Anticipatory Bail Application is allowed. ii.

In the event of arrest of applicant No. 1, namely Angad Sugriv Devkate, he shall be released on bail on furnishing P.R. bond of Rs. 50,000/- (Rupees Fifty Thousand only) with one or two solvent sureties in the like amount, in connection with FIR No. 244 of 2025 registered with 3/5

Sonpeth Police Station, District Parbhani, for the aforesaid offences, on the following conditions:

iii. The interim protection granted to applicant Nos. 2 and 3 by order dated 03.09.2025 is hereby confirmed, subject to the following conditions:

A) Applicant No. 1 shall attend the concerned police station and report to the Investigating Officer on 21st, 22nd, 28th and 29th April, 2026 between 12:00 noon and 02:00 p.m., and thereafter as and when called till filing of the charge-sheet. Insofar as applicant Nos. 2 and 3 are concerned, they shall attend the concerned police station as and when called till filing of the charge-sheet.

B) Applicant No. 1 - Angad Sugriv Devkate shall not enter village Mankadevi, Tq. Gangakhed, District Parbhani, till filing of the charge-sheet.

C) The Applicants shall also cooperate with the investigation.

D) The Applicants shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.

E) The applicants shall furnish copies of his Aadhaar Card and PAN Card to the Investigating Officer along with the addresses and mobile numbers of two nearest relatives.

Needless to say, violation of any of the aforesaid conditions may entitle the prosecution to seek cancellation of the anticipatory bail granted hereinabove.

The observations made herein are prima facie and shall not influence the Trial Court while deciding the case on its own merits. 9.

In view of the above, the Anticipatory Bail Application stands disposed of.
