This is the Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS) for Anticipatory Bail in Crime No.0135/2025 registered with Patoda Police Station, Dist. Beed for the offence punishable under Section 303 (2) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'), Sections 41 and 42 of Indian Forest Act, 1927, and Sections 3 and 4 of the Maharashtra Felling of trees (Regulation) Act, 1964. The said Crime is registered on the Report lodged by the Police.

Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers on record. 3.
It is the case of the Prosecution that, on 25.04.2025 the Police intercepted four (4) Motorcycles on which the Accused persons were
carrying pieces of Sandalwood worth Rs.2,80,000/- (Rs. Two Lakh Eighty Thousand). The said Articles were seized and the said persons were arrested. During interrogation it was revealed that the said Articles were to be purchased by the Applicant and therefore, the Applicant is apprehending his arrest.

The only material against the Applicant is the Statement of the Co-accused. Till the Report is received from the concerned Police Station, I am inclined to protect the Applicant by the following interim order.
ORDER
i) In the event of arrest of the Applicant, namely, Shivaji Nyandeo Vitkar in connection with Crime No.0135/2025 registered with Patoda Police Station, Dist. Beed for the offence punishable under Section 303 (2) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'), Sections 41 and 42 of Indian Forest Act, 1927, and Sections 3 and 4 of the Maharashtra Felling of trees (Regulation) Act, 1964, he be released on bail on executing P.B. of Rs.50,000/- (Rupees Fifty Thousand), with one or two surety / sureties in the like amount.
