By this Application, the Applicant is seeking protection from arrest in connection with Crime No. 0344 of 2025 registered with Cantonment (Chhawani) Police Station, District Chhatrapati Sambhajinagar City, for offences punishable under Sections 119(1), 115(2), 296, 351(2), 351(3), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The above-referred Crime is registered on the report lodged by the Applicant's wife. According to the Informant, there is a marital discord between her and the Applicant and, therefore, she was residing

2 914ABA1618.2025.odt with her parents from last two (2) years. She learnt that the Applicant has affair with one lady. She came to know that the Applicant and the said lady were sitting in a hotel on 21.08.2025. The Informant went to the said hotel where the Applicant abused and assaulted her. The other co-accused i.e. one lady and one more joined the Applicant. The gold chain of the Informant was snatched.

Admittedly, the first Informant has lodged a Criminal Case bearing R.C.C. No. 168 of 2025 for the offence punishable under Section 498A of the Indian Penal Code, and Case bearing PWDVA No. 301 of 2025 and an Application under Section 125 of the Code of Criminal Procedure, against the Applicant. For the very same incident, the Applicant has lodged report, and Crime bearing No. 0343 of 2025 came to be registered with the same Police Station against the Informant, her father and one more for offences punishable under Sections 109, 189(2), 191(2), 191(3), 190, 352, 351(1) and 351(3) of the Bharatiya Nyaya Sanhita, 2023. One of the co-accused in the cross FIR has been protected by this Court vide order dated 8th September, 2025 passed by this Court in Anticipatory Bail Application No. 1546 of 2025. In this view of the matter, prima facie, case is made out for grant of interim protection to the Applicant. Hence, the following order:

ORDER

[i] In the event of arrest of Applicant, namely, Pritam Mohan Rathod, in connection with Crime No. 0344 of 2025

3 914ABA1618.2025.odt registered with Cantonment (Chhawani) Police Station, District Chhatrapati Sambhajinagar City, for offences punishable under Sections 119(1), 115(2), 296, 351(2), 351(3), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on his furnishing P.B. of Rs. 15,000/- [Rupees Fifteen Thousand] with one surety in the like amount.

[ii] Issue notice to the Respondent/s, returnable on 22 nd September, 2025. Learned APP waives service of notice for the State.
