The Applicant is apprehending arrest at the hands of Ambad Police Station, District Jalna, in connection with Crime No.0453/2025, for the offence punishable under Sections 316(4), 316(5), 318(4), 324(5), 336(3), 338, 340(2), 339, 238, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 52 and 53 of the Disaster Management Act, 2005, and therefore, this Application for Anticipatory Bail is filed. 3.
The Crime is registered on the report lodged by the Sub-Divisional Officer, Ambad. It is the case of the Prosecution that, twenty two [22] FIR named Accused persons along with others have disbursed excess
amount towards the financial aid to the farmers for the loss suffered due to the natural calamity. In some cases excess land was shown, in some cases excess fruit bearing trees were shown, and in some cases bogus names were shown as farmers entitled to the amount. 4.
The Applicant was working as the Talathi of village Kandari Ambad, Tal. Ghansawangi, Dist. Jalna, having the charge of three (3) more villages, by name, Sajja Sevanta, Bhoggaon and Khalapuri, Tal. Ghansawangi. The papers on record show that, the Revenue Department had conducted an enquiry by Three (3) Member Committee. On the basis of the Report submitted by the Three
(3) Member Committee, the Collector issued Show Cause Notice to the Applicant dated 10.06.2025 seeking Reply for disbursing excess amount to the tune of Rs.33,83,573/-. The copy of the communication (Pg. No.175) dated 13.06.2025 shows that the Applicant responded to the Show Cause Notice by giving explanation showing the amount recovered from the agriculturists. According to the learned Advocate for the Applicant, the amount of Rs.9,68,002/- out of Rs.33,83,573/- is in the Government Account and by communication dated 11.07.2025 (at Pg. No.178) the Applicant requested for reverification of the amount disbursed for the village Bhoggaon and Kandari Ambad. One of the Co-accused, by name, Ramesh Laxman Kamble working as the Talathi is protected by this Court by order dated 20.09.2025 in Anticipatory Bail Application No.1652 of 2025. The copy of the Three (3) Member
Committee Report indicates the technical glitch in the process of disbursing the amount through online portal (pg No.96). Considering all these aspects, till the next date the Applicant is protected, so that the Application can be heard finally on merits, after the Report is received. Hence, the order.
ORDER
[i] In the event of arrest of the Applicant - Suraj Gorakh Bikkad in connection with Crime No.453/2025 registered with Ambad Police Station, District Jalna for the offence punishable under Sections 316(4), 316(5), 318(4), 324(5), 336(3), 338, 340(2), 339, 238, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 52 and 53 of the Disaster Management Act, 2005, he be released on bail on his furnishing P.B. of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.
