Heard the learned Advocate for the Applicants and the learned APP for the Respondents - State on the point of interim protection. Perused the papers on record.

This Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed by the Applicants seeking Anticipatory Bail, as they are apprehending arrest in connection with Crime No. 0408 of 2025 registered with Sailu Police Station, District Parbhani, for offences punishable under Sections 4, 25 of the Arms Act, 1959, Section 135 of the Maharashtra Police Act, 1951, and Sections 109, 115(2), 118(1), 118(2), 189(2), 189(4), 190, 191(2), 191(3), 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023.

On account of dispute over the use of Bandh road of the agricultural field, the incident in respect of assault took place on the morning of 04.08.2025. Both the sides assaulted each other. There is cross-FIR for the same incident. Allegations against the Applicants are that, they assaulted by fists and kick blows and criminal intimidation. No role of assault by weapon is attributed to the Applicants. The similarly placed Co-accused are protected, in Anticipatory Bail Application No.1624/2025, by order dated 24/09/2025. In this view of the matter, I am inclined to protect the Applicants by the following interim order.

ORDER

(I) In the event of arrest of the Applicants, namely, (1) Sidheshwar S/o. Vaijnath Ghule (2) Ravi S/o. Gajanan Ghule (3) Gaurav S/o. Gajanan Ghule, and (4) Gajanan S/o. Bhanudas Ghule, in connection with Crime No.0408/2025, registered with Sailu Police Station, Dist. Parbhani, for the offences punishable under Sections 4, 25 of the Arms

Act, 1959, Section 135 of the Maharashtra Police Act, 1951, and Sections 109, 115(2), 118(1), 118(2), 189(2), 189(4), 190, 191(2), 191(3), 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023, they be released on bail on executing P.B. of Rs.15,000/- (Rupees Fifteen Thousand) each, with one surety in the like amount. (II) The Applicants shall cooperate with the investigating machinery. (III) The Applicants shall attend Sailu Police Station, Dist. Parbhani once in a month on the last Friday between 02:00 p.m. to 06:00 p.m., until further orders.

(IV) Issue notice to the Respondents, returnable after four [04] weeks. The learned A.P.P. waives service of notice for Respondent Nos.1 and 2 - State.
