Heard the learned Advocate for the Applicant, the learned APP for Respondent No.1 - State and the learned Advocate appearing for Respondent No.2 on the point of interim protection. Perused the papers on record. The Affidavit-in-reply of Respondent No.2 is taken on record. 2.

The Crime bearing No.0452/2023 came to be registered with MIDC Police Station, District Latur, for the offences punishable under Sections 406 and 420 of the Indian Penal Code, 1860, on the report lodged by Respondent No.2 that, the Applicant, by promising handsome returns,

induced the Respondent No.2 to invest the money in securities. The Respondent No.2 invested Rs.10 Lakhs, received some of the amount and had not received the remaining amount, and therefore lodged the report. 3.

The learned Advocate for the Applicant submits that, the Applicant has paid the amount back to Respondent No.2. 4.

The learned Advocate for Respondent No.2 submits that, Respondent No.2 has no grievance against the Applicant, as he has received the amount.

In this view of the matter, the following order is passed:

ORDER

[I] In the event of arrest of the Applicant, namely, Pooja Vishant Bhoir, in connection with Crime No.0452/2023, registered with MIDC Police Station, District Latur, for the offences punishable under Sections 406 and 420 of the Indian Penal Code, 1860, she be released on bail on her furnishing P.B. of Rs.30,000/- [Rupees Thirty Thousand] with one or two surety / sureties in the like amount, on the following conditions:

[a] The Applicant shall attend the concerned Police Station as and when called by the Investigating Officer and shall cooperate with the Investigation. [b] The Applicant shall not influence or tamper with the Prosecution evidence in any manner.

[II] Issue notice to the Respondents, returnable on 13 th November, 2025 .

Learned APP waives service of notice for Respondent No.1 and the learned Advocate Mr. Gadekar waives service of notice for Respondent No.2.
