Heard Shri Ingole, Advocate holding for Mr. Rahul S. Kuwar,Advocate on the point of interim relief. It is the contention of the learned counsel for the applicant that the applicant was protected vide interim order granted by the learned Sessions Court vide order dated 18.10.2025. He has also annexed the copy of the same alongwith the present application.

Mr. Girase, learned PP, strongly opposes the grant/extension of ad-interim relief on the ground that the offences are serious in nature, pertaining to mob violence, wherein, police vehicle is torched and 40 police personnel are injured. The applicant is the main accused, who had instigated the entire mob in the name of agitation against the killing of one youngster belonging to his community. He, therefore, submits that

{2} this is not a fit case to grant ad-interim relief as custodial interrogation of the applicant is necessary.

After going through the order passed by the learned Sessions Judge dated 18.10.2025, it can be seen that the interim order was operating till the disposal of the bail application before the learned Sessions Judge. Perusal of para. 14 of the order dated 18.10.2025 would show that there is a mention that the entire incident is recorded in a CCTV footage. Same therefore needs to be seen to identify the role of the present applicant.

Learned Public Prosecutor is requested to make available the pen drive and the relevant photographs describing the role of the present applicant in the mob violence, for perusal of this court. 6.

I am, therefore, inclined to grant extend the interim order dated 18.10.2025 as granted by the learned Sessions Judge, till 14.11.2025.

Hence,the following order :-

O R D E R

[I] In the event of arrest of the present applicant in connection with Crime No.583 of 2025, dated 25.9.2025 registered with Nandurbar City Police Station, for the offences punishable under Sections 61-2, 1091, 190, 189-2, 191-2, 132, 121-2, 324-3, 324-5, 324-6, 118-1, 326-f, 125A, 125-B of the Bhartiya Nyaya Sanhita and Sections 3 and 7 of the Prevention of Damage to Public Property Act and Under Sections 3 of the Criminal Law Amendment Act and u/section 37(1), 37(3) and 135 of the Maharashtra Police Act, he shall be released on bail on furnishing P.R. Bond in the sum of Rs. 1 Lakh with one or more sureties in the like amount.

{3} [ii] The applicant shall attend the Investigating Officer of Nandurbar City police station from 10th November, 2025 to 13th November, 2025 between 10.30 a.m. and 12.30 p.m. and shall cooperate the I.O. in the investigation.

[iii] The Investigating Officer shall remain present during the course of hearing on 14.11.2025 and shall report about cooperation of the applicant.

[iv] Stand over to 14.11.2025.
