Issue notice to the Respondents, returnable on 01.12.2025. Learned APP waives service of notice for Respondents/State. 3.

On the point of interim relief, the learned Counsel for the Applicant submits that the Applicant's father is the owner of land adjacent to that of the victim's father. There are disputes regarding the right of way to the village, and therefore the Applicant has been falsely implicated in the present crime.

Considering the fact that there is a delay of three days in filing the FIR, I am inclined to protect the Applicant till the returnable date. Hence the following order :

ORDER

(a) In the event of arrest of the Applicant - Rohit Alias Gautam

2 925.ABA-1992-2025.doc Nanasaheb Jadhav in connection with Crime No.174/2025 registered with Ashwi Police Station, District Ahilyanagar, he be released on bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousands) with two solvent sureties in the like amount, on the following conditions : (b) The Applicant is directed to attend the Investigating Officer at Ashwi Police Station, District Ahilyanagar on 17th to 20th and 24th to 27th of November, 20254 between 11:00 am. to 01:00 pm. and cooperate with the Investigating Officer. (c) The Applicant shall not tamper with the evidence and shall appear before the Investigating Officer as and when required, apart from the dates already mentioned above.

(d) The Investigating Officer shall make the investigation papers available for perusal of this Court.
