Issue notice to the Respondents, returnable on 09.12.2025. Learned APP waives service of notice for Respondent/State. 3.

Looking to the nature of the allegations, and considering the submission that the complainant was seen in the CCTV footage on 29.09.2025 riding a motorcycle with milk cans, as well as the submission that the complainant has falsely stated that he was admitted again on 29.09.2025 in the hospital due to vomiting, and further noting that there is a delay of five days in lodging the FIR, I am inclined to protect the Applicant till the returnable date. Hence the following order :

ORDER

(a) In the event of arrest of the Applicant - Dnyaneshwar Alias

2 916.ABA-2017-2025.doc Mauli Bhausaheb Chobhe in connection with Crime No.858/2025 registered with Ahilyanagar Taluka Police Station, District Ahilyanagar, he be released on bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousands) with two solvent sureties in the like amount, on the following conditions : (b) The Applicant is directed to attend the Investigating Officer at Ahilyanagar Taluka Police Station, District Ahilyanagar from 24th to 28th of November, 2025 between 12:00 pm. to 02:00 pm. and cooperate with the Investigating Officer. (c) The Applicant shall not tamper with the evidence and shall appear before the Investigating Officer as and when required, apart from the dates already mentioned above.

(d) The Investigating Officer shall make the investigation papers available for perusal of this Court.
