Heard learned counsel for the applicant and the learned APP for the respondent-State.

Issue notice to the respondents, returnable on 16.12.2025. The learned APP waives notice on behalf of the respondent - State. 3.

The applicant has approached this Court apprehending arrest in connection with FIR bearing Crime No. 418 of 2025 dated 16.11.2025, registered with Javaharnagar Police Station, District Chh. Sambhajinagar for the offences punishable under Sections 67, 67-A of the Information Technology Act and 75, 78, 356(2) and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

Taking into consideration that the complainant had earlier lodged an FIR bearing Crime No. 437 of 2025, dated 25.10.2025, on identical allegations against the present applicant and that the applicant was granted anticipatory bail by the learned Additional Sessions Judge, Aurangabad, vide order dated 25.11.2025, and further considering that the allegations in the present FIR bearing Crime No. 418 of 2025, dated 16.11.2025, are almost identical to those in the earlier FIR No. 437 of 2025, in which the applicant has already been released on anticipatory bail. Hence, I am inclined to protect the present applicant, however, subject to certain conditions, which are as follows :-

O R D E R

In the event of arrest of the Applicant - Chetan Kantilal Sabadra, he be released on bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousand) with one or two solvent sureties in the like amount each, in connection with FIR bearing Crime No. 418 of 2025 dated 16.11.2025, registered with Javaharnagar Police Station, District Chh. Sambhajinagar for the offences punishable under Sections 67, 67-A of the Information Technology Act and 75, 78, 356(2) and 351(2) of the Bharatiya Nyaya Sanhita, 2023, on the following conditions :

A) The Applicant is directed to attend the concerned police station and report to the Investigating Officer on every Friday, Saturday and Sunday between 10:30 2/3

a.m. to 01:30 p.m., till the investigation papers are available to this Court.

B) The applicant shall also handover his mobile phone to the Investigating Officer C) The Applicants shall also cooperate with the investigation.

D) The Applicants shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.

The attendance of the applicant shall be treated as custody for the purposes of Section 23 of the Bharatiya Nyaya Sanhita, 2023. 6.

Needless to say, violation of any of the aforesaid conditions, may entitle the prosecution to seek cancellation of bail. 7.

The Investigating Officer shall make available the investigation papers on the next date of hearing.
