Heard learned counsel for the applicant and the learned APP for the respondent-State.

Issue notice to the respondents, returnable on 06.01.2026. The learned APP waives notice on behalf of the respondent - State. 3.

The applicants have approached this Court apprehending arrest in connection with FIR No. 0647 of 2025, dated 24.11.2025, registered with Ambad Police Station, District Jalna, for the offences punishable under Sections 123, 115(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Taking into consideration the nature of allegations against the applicants - Harishchandra Baliram Aargade and his wife, Mohini Harishchandra Aargade, wherein it is alleged that they had only caught hold of the complainant, and it is the other accused - Baliram Aargade and Kisan Aargade - who are alleged to have forcibly administered poison to the complainant, I am inclined to protect the applicants till the investigation papers are perused.

O R D E R

In the event of arrest of the Applicants - Mohini Harishchandra Aargade and Harishchandra Baliram Aargade, they shall be released on bail on furnishing P.R. bond of Rs. 50,000/- (Rupees Fifty Thousand) each, with one or two solvent sureties in the like amount each, in connection with FIR No. 0647 of 2025, dated 24.11.2025, registered with Ambad Police Station, District Jalna, for the offences punishable under Sections 123, 115(2), 352, 351(2) and 3(5) of the BNS, 2023, subject to the following conditions :- A) The applicants shall attend the concerned police station and report to the Investigating Officer every Monday between 12:00 noon and 02:00 p.m.

B) The Applicants shall also cooperate with the investigation.

C) The Applicants shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.

Needless to say, violation of any of the aforesaid conditions may entitle the prosecution to seek vacation of the interim relief granted herein above.

The Investigating Officer shall make available the investigation papers on the next date of hearing.

7.

Stand over to 06.01.2026.
