Issue notice to the Respondents, returnable on 12.01.2026. Learned APP waives service of notice for Respondents/State. 3.
The learned Counsel for the Applicants submits that the Applicant No.1/Pandurang was not present on the spot and was at Paithan when the incident occurred, and the Applicants have been falsely implicated in the present crime. There is a delay of 12 days in lodging the FIR, and counter FIRs have been filed at the behest of the present Applicants, being FIR No. 61/2025 and N.C. Report No. 1133/2025. The other party has already been granted protection by this Court in ABA No. 1494/2024. The wife of Applicant No.1, Jayshree, has also been protected by interim order dated 24.11.2025
2 20.ABA-2201-2025.doc passed by this Court in ABA No. 2055/2025. Hence, the present Applicants also deserve protection.

Thus, taking into consideration the above submissions, I am inclined to protect the Applicants till the investigation papers are received. Hence the following order :
ORDER
(a) In the event of arrest of the Applicants - Pandurang Maruti Shelke and Rajendra Maruti Shelke in connection with Crime No.769/2025 registered with Shevgaon Police Station, District Ahilyanagar, they be released on bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousands) each with two solvent sureties in the like amount, on the following conditions : (b) The Applicants are directed to attend the concerned police station on Thursday and Friday of every week between 11:00 am. to 01:00 pm. and co-operate with the Investigating Officer. (c) The Applicants shall not tamper with the evidence and shall appear before the Investigating Officer as and when required, apart from the days already mentioned above.
(d) The attendance of the Applicants shall be treated as deemed custody for the purpose of Section 23 of the Bharatiya Sakshya Adhiniyam, 2023.
(e) The Investigating Officer shall make the investigation papers

The present application be heard alongwith Anticipatory Bail Application No.2055/2025 on 12th January, 2026. MEHROZ K. PATHAN JUDGE NAJEEB..
