Shinde, Counsel for the applicant/appellant, Mr. N.R. Rode, APP for the respondent/State.
CORAM : ABHAY J. MANTRI, J.
DATE : 06-06-2025 The applicant/appellant has moved this application for suspension of the sentence imposed vide judgment and order dated 08-05-2025, passed in Sessions Case No. 220/2023 for the offence punishable under Section 353 of the Indian Penal Code, and for releasing him on bail during the pendency of the appeal. 2.
Heard the learned Counsel for the applicant.
3.
At the outset, it appears that during the pendency of the trial, the applicant was on bail. Similarly, after passing the impugned judgment and order of conviction, the order was suspended till the appeal period, and the applicant was released on bail. It also appears that the applicant has deposited the fine amount of Rs. 10,000/- with the learned trial Court.
4.
Thus, having considered the grounds raised in the application and appeal memo as well as the nature of the offence, in my view, it would be proper to suspend the
2 appa479.25.odt sentence and release the applicant on bail during the pendency of the appeal, as the appeal will take its own time.
5.
Hence, I pass the following order:
(i) The sentence imposed on the applicant by the impugned Judgment and order dated 08.05.2025 in S.C. No. 220/2023 is hereby suspended till the disposal of the appeal.
(ii) The applicant shall be released on bail on furnishing P.R. and S.B. in the sum of Rs. 50,000/- (Rupees Fifty Thousand).
(iii) Bail before the learned trial call.
6.
The application is disposed of accordingly.
Criminal Appeal No.270/2025.

2.
Issue notice to the respondent, returnable after four weeks.
3.
Mr. N.R. Rode, learned APP, waives service of notice on behalf of the respondent/State.
4.
