The Application is for condonation of delay.

By this Appeal, the Appellant has challenged the judgment and order passed by the Special Judge Bhandara dated 13.03.2025 convicting the present Appellant by sentencing him rigorous imprisonment for 20 years and fine of Rs.1,000/- for the offence punishable under Section 6 of the Protection of Children from Sexual Offences Act, 2012, rigorous imprisonment for 5 years and fine of Rs.1,000/- for the offence punishable under Section 10 of the Protection of Children from Sexual Offences Act, 2012, rigorous imprisonment for six months for the offence punishable under Sections 506 and 342 of IPC and rigorous imprisonment for three months under Section 323 of IPC.

Heard learned Counsel for the Appellant, who submitted that the Appellant is behind bar and unable to contact his family members in order to engage the Counsel to prefer an Appeal, and therefore, the delay of 64 days is caused and if the delay is not condoned the statutory right of the present Appellant to prefer an Appeal would affect. 4.

Learned APP, strongly opposed the said Application and submitted that there is no reasonable ground to condone the delay, and therefore, the Application for condonation of delay deserves to be rejected. 5.

Considering the reasons mentioned in the Application and if the delay is not condoned the statutory right of the present Appellant to prefer an Appeal will be affected. In view of that, the delay which is caused in preferring the Appeal against conviction, is hereby condoned. The delay Application is disposed of.

The Appeal be registered.
