08/04/ This is an Application for relaxation of condition no. (iii) imposed by this Court vide judgment and order dated 11/02/2025 in Criminal Appeal No. 04/2025. 2.
The said condition is that, the Applicant/Appellant/Accused no. 3 shall not enter the territorial limits of Chandur Railway, Taluka District Amravati.

The learned counsel for the Applicant submits that, the material witnesses are examined by the prosecution and therefore, there is no question of tampering with the prosecution witnesses. He submits that, the said condition be relaxed.

On instructions, the learned APP for the State submits that, the prosecution has examined the victim, informant, victim's father and Doctors.

The judgment and order, by which, the bail was granted shows that, the said condition was imposed, as the learned counsel for the victim had expressed apprehension of tampering with the witnesses. Undisputedly, the victim, her relatives, Doctors and panch witnesses are examined by the prosecution. The period of one (1) year and two (2) months has passed since the imposition of said condition. Hence, the present Application is allowed and the Condition no. (iii) imposed in the above referred bail order is relaxed.
