Amongst other evidence, we find that the evidence of PW-4, who is also an injured witness, establishes the involvement of the appellant in the crime. He has deposed that the appellant assaulted him on the waist by means of a spear (Bhala). He further assaulted PW-4's sister on her chest with the said spear. She succumbed to the injury. 03.

We have gone through the cross-examination, she withstood the same. The theory is corroborated by the recovery of the spear at the instance of the appellant. For the forgoing reasons, we are not inclined to suspend the sentence. The application is, accordingly, rejected. 04.

List the appeal as per rules.
