The applicant has filed the present application, assailing the judgment and order dated 14.08.2025, passed by the District Judge-3 and Additional Sessions Judge, Nagpur in Sessions Case No. 257/2022, thereby the applicant / appellant was convicted. 2.

Learned counsel for the applicant submits that the delay in preferring the present appeal is neither intentional nor deliberate. It is stated that the applicant was not aware of the statutory remedy available to him, which resulted in a delay of 60 days in filing the appeal.

Per contra, learned Additional Public Prosecutor submits that the applicant has failed to demonstrate sufficient cause for condonation of delay and, therefore, the application deserves to be rejected.

Upon consideration of the submissions, I am of the view that the applicant has demonstrated sufficient cause for condonation of delay. Accordingly, the delay of 60 days in filing the appeal is condoned, and the application is allowed.

The appeal shall be registered accordingly.
