By present application, the applicant is seeking condonation of delay of 777 days in filing appeal against judgment and order dated 10-8-2023 passed by the Sessions Court, Gadchiroli in Sessions Case No. 36/2021 thereby convicting the applicant/ appellant for the offence punishable under Section 302 of the Indian Penal Code.
Learned counsel for the applicant submits that delay is caused because of various reasons viz. restrictions of movement, restrictions to contact counsel and most importantly, financial constraints to appoint counsel. Ultimately, the applicant came to know that there is facility of legal aid and accordingly, counsel is appointed and appeal filed.
Order appa 995.2025.odt Learned Additional Public Prosecutor submits that delay is not properly explained. However, we find that the reasons assigned show sufficient cause to condone delay. The application is accordingly allowed. Delay is condoned. Appeal be registered.
