This is an application for withdrawal of amount deposited by the accused/non-applicant no.1 - A.S. Ingle. This Court by its judgment and order dated 21.07.2018 was pleased to hold that the non-applicant/ respondent-accused is guilty of committing the offence under Section 138 of the Negotiable Instruments Act. It is further observed that the respondent/accused shall deposit Rs.1,20,000/- within three months, and on deposit of said amount, an amount of Rs.90,000/- be given to the appellant/complainant.

The learned Counsel for the applicant submits that at the relevant time the amount could not be withdrawn by the applicant for the reason that the applicant - Unnati Mahila Nagar Sahakari Pat Sanstha Maryadit, Malkapur went under liquidation. Now a liquidator has been appointed and he has moved this application on behalf of the Pat Sanstha.

Considering above facts and circumstances, it is not necessary to issue notice to non-applicant no.1 A.S. Ingle. The State of Maharashtra is represented by the learned A.P.P.

In view of the judgment and order dated 21.07.2018, the applicant Pat Sanstha is permitted to withdraw the amount of Rs.90,000/-, as observed by this Court in the above order. The amount be permitted to be withdrawn along with accrued interest, if any.

Criminal Application is accordingly allowed and disposed of.
