The learned counsel for the respondent submits that he has filed the present application seeking withdrawal of the amount of Rs. 1,00,000/- deposited by the appellant before this Court. The learned counsel for the appellant has no objection to the respondent being permitted to withdraw the said amount, subject to the respondent furnishing an undertaking that, in the event the appellant succeeds in the appeal, the respondent shall refund the amount.

Considering the aforesaid submissions, the respondent is permitted to withdraw the amount of Rs. 1,00,000/- deposited by the appellant before this Court.
