By preferring this application, the applicant is seeking relaxation of condition which is imposed in Criminal Application (BA) No.881/2022 by which the applicant is directed to attend the concerned Police Station on every 1st day of each month between 10.00 a.m. to 12.00 noon, till the culmination of trial. Now the investigation is already completed, charge-sheet is filed. The entries in the diary also shows that the applicant has attended the concerned Police Station as per the directions of this Court. Till today, the charge is not framed. The trial will take its own time.

Considering this aspect, the application deserves to be allowed by modifying the condition. Accordingly, I proceed to pass following order:

ORDER

(i) The application is allowed.

(ii) The condition imposed on the applicant that he shall attend the concerned Police Station on every 1st day of each month between 10.00 a.m. to 12.00 noon, till the culmination of trial is hereby modified and the applicant is directed to attend the proceeding before the trial Court without seeking any exemption unless there are exceptional circumstances and shall not leave the jurisdiction of Chandrapur City without seeking permission of the District Court, Chandrapur. The application is disposed of.
