By this application, the original complaint is seeking permission to engage counsel to assist the prosecution as well as to intervene in the proceedings.

In view of the reasons mentioned in the application, application is allowed. Permission permission is granted to intervene in the application.

CRIMINAL APPLICATION (ABA) NO. 526 OF 2025 1.
Apprehending the arrest at the hands of police in connection with Crime No.351/2025 registered with Police Station Desaiganj, Tah. Desaiganj, Dist. Gadchiroli for the offences punishable under Sections 3(5), 316(2) and 316(4) of the Bhartiya Nyaya Sanhita, 2023, the applicant
2 907.A.B.A.526-2025.odt approached this Court for grant of pre-arrest bail. 2.
Heard learned counsel for the applicant, who submitted that the present FIR is lodged on an allegation that there was a business transaction between the complainant and the present applicant. It is alleged that the present applicant was the owner of NRB Constructions, who obtained the steel from the complainanct and did not keep the account of the same, and thereby, duped the complainant to the tune of Rs. 88,80,000/- and also disposed of the said steel, which was obtained from the complainant. On the basis of the said report, police have registered the said crime against the present applicant.

Learned counsel for the applicant submitted that, as far as custodial interrogation is concerned, it is not required. The applicant is ready to cooperate with the investigating agency. The FIR came to be lodged out of a business transaction. In view of that, he be protected by granting adinterim protection. 4.
Learned APP and learned counsel for the complainant strongly opposed the said application and submitted that since inception, there was an intention to cheat the complainant, and therefore, the present applicant did not maintain the account and also stole and disposed of the said steel without any permission of the present complainant and sold it to the scrap vendors. In view of that, his custodial interrogation is required.

On hearing both sides and on perusal of recitals of the FIR and considering the nature of allegations, the immediate
3 907.A.B.A.526-2025.odt custodial interrogation of the present applicant is not required. The aspect of the interrogation can be taken care of by imposing certain conditions on the present applicant. In view of that, prayer for grant of ad-interim protection deserves to be allowed. Accordingly, I pass the following order..
O R D E R
a] Issue notice to the non-applicant, returnable after two weeks.
b] Learned APP waives service of notice on behalf of non-applicant/State and seeks time to file reply.
c] In the event of arrest, the applicant- Ranjit s/o Gangaram Bisane shall released on ad-interim anticipatory bail in connection with Crime No.351/2025 registered with Police Station Desaiganj, Tah. Desaiganj, Dist. Gadchiroli for the offences punishable under Section 3(5), 316(2) and 316(4) of the Bhartiya Nyaya Sanhita, 2023, on execution P.R. bond of Rs.25,000/- with one solvent surety in the like amount.
d] The applicant shall attend the concerned Police Station once in a week on Monday between 10:00 a.m. to 01:00 p.m. and shall co-operate with the Investigating Agency.
e] The applicant shall not leave the jurisdiction of

f] The applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case.
g] The applicant shall furnish his detailed address along with address proof before the Investigating Officer.
