By this Application, permission is sought to file prosecution complaint before the Special Court. 2.
It is specifically stated that in terms of Section 8(3) of the Prevention of Money Laundering Act, 2002 (for short, 'PMLA') the prosecution complaint is required to be filed before the Competent Court from the date of confirmation order. In the present case the period of 365 days is going to be expired on 27/1/2026, hence, as per the mandate of the provisions of PMLA it is necessary to file the prosecution complaint in the matter. 3.
The learned Counsel for Applicant opposed the present Application by stating that he has challenged for forensic audit report before this Court vide Writ Petition Nos. 5885/2024
2/2 14.APPP.2822.2025.odt and 7051/2024. According to him, the decisions in both the Petitions are direct bearings on the present Application. He made a request that after the decision of the Writ Petitions appropriate order can be passed in the present Application. 4.
In the circumstances, in my opinion, filing of prosecution complaint will not cause any prejudice to the Applicant and Applicant can always be permitted to challenge the said prosecution complaint in the present case also.
