As far as Section 351(2) and 352 of Bhartiya Nyaya Sanhita, 2023 (BNS) are concerned, the said offences are not cognizable. The only question that arises for consideration is, whether Section 329 (4) of the BNS is made out in the facts, considering that there is civil suit with respect to the property in question between the parties.

Learned Addl.PP seeks time. On his request stand over to 28th November, 2025. In the meantime, till the next date, investigation to continue however, chargesheet not to be filed without the leave of this Court.
