.................................................................................. Mr. Viral K. Rathod, for the Applicants.
Mr. S.V. Gavand, Additional P.P., for the Respondent-State. ................................................................................... CORAM : SARANG V. KOTWAL & MANJUSHA DESHPANDE, JJ.
DATE : 26th JUNE 2025 P.C. :- 1.
This Application is moved for Speaking to the Minutes to correct the order dated 4th March, 2025. Learned Counsel for the Applicants submitted that there was a typographical error in prayer clause (A), where the case number was mentioned as CC No. 2022/PW/2023. The same number was mentioned in the Paragraph No. 1 and the operative part Paragraph No. 7 of the order dated 4th March, 2025.
2.
Learned Counsel submitted that the corrected CC number is mentioned in prayer clause (B) as
CC No. 2082/PW/2022. He submitted that this typographical error be permitted to be corrected in the original Application and consequently, it may be mentioned in the order as well. He submitted that the CR number mentioned in the order, i.e., CR No. 800 of 2021, registered with Dharavi Police Station, Mumbai, is correct. Therefore, it appears to be a genuine inadvertent typographical error. The mistake was realized when the Petitioner approached the Trial Court. The CR number is correctly recorded, therefore, it is easy to co-relate the case number with the CR number. 3.
This typographical error is required to be corrected. Hence, the following order.
ORDER
[i] Leave to amend is granted to correct the prayer clause (A) to mention the correct case number. Amendment be carried out forthwith.
[ii] Consequently, the case number i.e.
"CC No.2022/PW/2023" mentioned in paragraph No. 1 & in
the operative part of paragraph No. 7(i) of the order dated 4th March, 2025 stands corrected to read as "CC No. 2082/PW/2022".
[iii] This order shall be read together with the order dated 4th March, 2025.
[iv] The order dated 4th March, 2025 stands corrected to the aforesaid extent only. Rest of the order shall remain as it is. [MANJUSHA DESHPANDE, J.] [SARANG V. KOTWAL, J.]
