In both these matters, the prayer is made for quashing of the proceedings pending before the Judicial Magistrate First Class, Satana, District Nashik, in R.C.C. No.301 of 2024 and C.R. No.440/2024 registered with Satana Police Station, Nashik, u/s 498-A, 323, 504, 506, r/w 34 of the Indian Penal Code. 3.

Heard Mr. Deepak Pote, learned Counsel for the Applicants, Mr. Sandesh V. Kate, learned counsel for the Respondent No.2 and Smt. M. H. Mhatre, learned APP for the State.

The FIR is lodged on 15/06/2024 by the Respondent No.2 in both these matters. The Criminal Application No.423 of 2024 is filed by her husband Ravi, whereas the Criminal Application No.1132 of 2024 is filed by the brother-in-law, brother-in-law's wife and father-in-law of the Respondent No.2. The parties have settled the matter. Therefore it is not necessary to refer to the allegations in detail as mentioned in the FIR. 5.

However, the gist of the allegations are that before

3 / 4 marrying the Applicant, the informant was married to her first husband and had a son from that marriage. She was divorced. She got married with the Applicant Ravi on 18/05/2022. It was his third marriage. But this fact was concealed from the informant. After marriage, all the Applicants started ill-treating her. She was not allowed to accompany the Applicant Ravi to his place of employment. He was employed in Army. There are allegations that the informant was made to do all the household work. She was assaulted. Whenever, the husband used to visit their house, he used to assault her. There are allegations that there was demand of Rs.10 lakhs from her. The Applicant had misappropriated her Stridhan. On these allegations, the FIR is lodged. 6.

The charge-sheet contains the statements of neighbours of her parents, who have supported the informant's case. However, the now the parties have settled the matter. A Compromise Deed executed by the Respondent No.2 and the Applicant Ravi is tendered in the Court. There is a specific clause in that deed that the Respondent No.2 was giving no objection for quashing of the present proceedings in both these

4 / 4 applications. She is present in the Court. She is identified by her learned Counsel. She reiterated the clauses in the Compromise Deed. She stated before the Court that she has no objection for quashing of these proceedings. The settlement is arrived at to her satisfaction.

The dispute between the parties is personal in nature. Therefore, we are inclined to allow these applications. 8.

Hence, the following order :

O R D E R

(i) The FIR registered vide and C.R. No.440/2024 registered with Satana Police Station and the R.C.C. No.301 of 2024 pending before Judicial Magistrate First Class, Satana, District Nashik, are quashed and set aside.

(ii) The applications are disposed of.
