Heard the learned Counsel for the parties.

The applicant is aggrieved by an order dated 27 February 2025, whereby the learned Magistrate has declined to set aside the order dated 18 September 2024, closing the evidence of the applicant-accused in Criminal Case No.580/SW/2017.

It is submitted that the applicant would face grave prejudice if he is not permitted to adduce evidence in the matter.

Issue notice to the Respondents, returnable on 15 January 2026. 5.

Learned APP waives service on behalf of Respondent No.2. 6.

In addition to notice through Court, the Applicant is at liberty to serve the Respondent No.1 by private service and file an affidavit of service. SSP 1/2
