Heard the learned Counsel for the parties.

The challenge in this Application is to an order dated 4 April 2025 passed by the learned Additional Sessions Judge, whereby an application preferred by the Applicant for modification of the condition of bail i.e. not to enter the vicinity of Dongri, till further orders, came to be rejected. 3.

Learned Counsel for the Applicant submits that the co-accused Shayams Ali Sayyed has lodged multiple non-cognizable complaints against the applicant, and, therefore, the learned Additional Sessions Judge was persuaded to reject the application.

Learned APP resisted the prayer to modify the condition not to enter the vicinity of Dongri on the ground that, after the passing of the impugned order SSP 1/2

28 apl 529 of 2025.doc by the learned Additional Sessions Judge, one more crime has been registered against the Applicant at J.J.Marg Police Station. 5.

The first informant in the FIR which led to registration of C.R.No.176 of 2021 has no objection to modify the aforesaid condition. 6.

The Court finds that the order releasing the Applicant on bail was passed on 11 June 2021. The condition not to enter the vicinity of Dongri was to be operative till further orders. Though multiple FIR seems to have been lodged against the Applicant, yet, a number of NC complaints seem to have been lodged by co-accused Sham Ali Sayed. There appears rivalry between the applicant and the co-accused.

Learned Counsel for the first informant - Respondent No.2, on instructions, submits that the Respondent No.2 has no objection to modify the said condition.

Having regard to the time that has elapsed and the fact that the applicant resides in a contiguous area, the condition not enter vicinity of Dongri, is even otherwise, impracticable, this Court is inclined to modify the said condition.

Hence, the condition not to enter the limits of Dongri, stands relaxed. 10.

Criminal Application stands disposed.
