A First Information Report No.18 of 2021 was filed by the respondent no.2 on account of issues arising from a matrimonial disputes against the applicants. Now, the matrimonial differences between the applicants and the respondent no.2 have been amicably resolved and as stated at Ground "5(b)" at page 11, the parties want to stay happily together along with their children. 2.
Therefore, the present Criminal Application is filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and Digitally signed by SNEHA ABHAY DIXIT Date:

section 482 of the Code of Criminal Procedure, 1973 seeking the following reliefs:
" (a) That the Hon'ble Court after examining the legality and validity of CR/FIR No. 18 of 2021 registered with L.T. Marg police station for offense punishable u/s 143, 147, 452, 454 & 323 of the Indian Penal Code, 1860 and the Criminal Proceeding bearing case no. 641/PW/2022 pending with the file of Hon'ble Additional Chief Judicial Magistrate 3rd Court, Esplanade at Mumbai be quashed and set aside." 3.
The respondent no.2 has filed an affidavit dated 8th September 2025 recording his consent to the quashing of the FIR and any proceedings arising therefrom. The said affidavit also exhibits the Aadhar Card of the respondent no.2 for identification. The said affidavit is taken on record and marked as "X" for identification. Ms. Pandey, the learned counsel for the respondent no.2 further reiterates her client's no objection to the quashing of First Information Report.

As held by the Hon'ble Supreme Court in "Jitendra Raghuvanshi v. Babita Raghuvanshi", (2013) 4 SCC 58 that the Court is empowered to quash the criminal proceedings particularly in matrimonial disputes wherein the parties have reconciled their differences. Therefore, continuation of any criminal proceedings thereafter would serve no fruitful purpose. Therefore, prayer clause (a) of Criminal Application No.561 of 2025 is granted and accordingly disposed of.
