In view thereof, we are not inclined to entertain this Criminal Application and the same is dismissed with liberty to the applicant to avail of the remedy available to him including filing of a fresh writ petition/criminal application laying a challenge to the order taking cognizance.

We may, however, indicate that the dismissal of this Criminal Application shall not be construed as if this Court has expressed any opinion on the merits of the case.
