At the outset, Mr. Havnur, learned Counsel appearing for the Applicants states that as in the impugned Order, it is stated that the action under Section 340 of Code of Criminal Procedure, 1973 cannot be initiated at this stage, he has instructions not to press this Criminal Application with liberty to file appropriate application, at appropriate stage.

Accordingly, Criminal Application is allowed to be withdrawn with liberty as prayed.
